Welcome to TongueScan. These Terms of Service ("Terms") govern your use of the TongueScan mobile application ("App") developed by Naveed Avery ("I," "me," or "my"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

TongueScan is a wellness application that uses AI technology to analyze photographs of your tongue and provide health-related insights based on research-backed biomarkers and clinical correlations.

The information provided by the App is for general informational and educational purposes only. It should not be considered medical advice or a substitute for professional healthcare.

TongueScan offers both free features and a premium subscription ("Premium") with additional functionality.
Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms and payment processing.
Premium is available as weekly, annual, or lifetime subscriptions. Recurring subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage and cancel subscriptions in your Apple ID settings.
Refunds are subject to Apple's refund policies. I do not process refunds directly.
You agree NOT to:
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, audio, software, and AI models — are owned by Naveed Avery and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You retain ownership of images and data you create using the App. By using the App, you grant me a limited license to process your tongue images for the purpose of providing the analysis service.
I do not claim ownership of your personal health data.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
I do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVEED AVERY SHALL NOT BE LIABLE FOR:
Total liability shall not exceed the amount you paid for Premium subscriptions in the 12 months preceding the claim.
You agree to indemnify and hold harmless Naveed Avery from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
I may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.
You may stop using the App at any time by deleting it from your device.
I may modify these Terms at any time. I will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Naveed Avery regarding the App.
